[1]"Hugh Phelps and John G. Henderson represented Wood County through Dec. 10. Abner Lord and Joseph Spencer were then declared elected and served in office two days. [2]This election was contested because a separate poll sheet was found, but not included in the original totals. The votes from the separate poll gave Abner Lord 11 additional votes, Joseph Spencer 11 additional votes, Hugh Phelps 39 additional votes and John G. Henderson 39 additional votes. If the two polls had both been counted the totals would have been Abner Lord = 69, Joseph Spencer = 66, Hugh Phelps = 89 and John G. Henderson = 87, thereby changing the result of the election.
[3]"That on a separate List of persons who Refused to Sware that they were freeholders, your Petitioners had Each 11 Votes and Hugh Pehlps and John G. Henderson had Each 39 Votes as will Appear from an Attested Copy of the Poll Book. The Election being Closed the Sheriff who conducted the same Declared Abner Lord and Joseph Spencer to be duly Elected to represent the county of Wood in the next General Assembly.
