[4]"Mr. Cheever ~ I beg leave to call your attention for a few moments to the decision of the Honorable Council, on the returns from the Sixth Eastern District. The votes of Freedom were rejected; these would have decided the election. I have understood the circumstances to be these. The original return of Freedom was lost; but the Selectman, within the time prescribed by law forwarded a duplicate, certified by them and the Town Clerk, as a copy of the record. This was regularly returned by the Sheriff; but was rejected by the Honorable Council, as it was not, as the law required, 'sealed up in open town meeting'. I have always understood the law to be, that when the original which is matter of record is lost, a fair copy of the record should be received as evidence." [5]"The executive have set aside the return from the town of Freedom as being irregular, otherwise the election would stand thus: Conner 1318 Freedom 53, 1371. Boutelle 1304 Freedom 6, 1310. Scattering 52. Whole number 2733, Necessary to a choice 1367. Samuel S. Conner, Esq. 1371. This it will be seen that Col. Conner, the Republican candidate has a majority of votes, over all the candidates ~ and ought to have been declared elected ~ the circumstances attending the return from the town of Freedom, are such as would leave no doubt in the minds of fair men what would be the decision of Congress on this subject, who are finally to be the judges of the Election of their own members."
