[6]There was a tie vote between Alexander Hamilton and William Floyd. Mr. Benson made a motion "that Alexander Hamilton, be nominated by this House, as one of the Delegates to represent this State." A second motion was offered by Mr. Jones: "that the motion of Mr. Benson be amended by striking out the name of Alexander Hamilton, and by inserting the name of William Floyd, instead thereof." This second motion was defeated by a vote of 26 to 24 and Alexander Hamilton was declared to be elected.
[7]"Resolved: That Ezra L'Hommedieu, Egbert Benson, Alexander Hamilton, Abraham Yates Jr., and Leonard Gansevoort, be, and they are hereby declared duly nominated and appointed, Delegates to represent this State, in the United States of America, in U.S. House of Representatives Assembled, to hold their seats in U.S. House of Representatives from the day of their appointment, unil the first Monday in November next, and thence forward, until ten days after the subsequent meeting of the Legislature: Provided, nevertheless, that the said Delegates shall not on any account, hold their seats longer than one year, to be computed from the day of their appointment."
