[3]This election was contested and the Committee on Elections decided based on depositions given that Ezra Batchelder was not entitled to his seat. Three of the voters who had voted for Batcheldor were declared to have been ineligible to vote. "Upon these facts, the Committee unanimously report, that the said supposed election of the said Ezra Batcheldor was utterly void and of no effect, and that he is not entitled to a seat in this House, and that his seat therein should be declared vacated."
