[3]Massachusetts law required a majority to elect. Ammi R. Mitchell would subsequently be elected by the Massachusetts General Court.
[4]The Hon. Lathrop Lewis Esq. had 2834 votes and is chosen. There is one vacancy in this District. 2791 votes are returned for the Hon. Levi Hubbard Esq. and he is one of the Candidates. 2678 votes are returned for Ammi Ruhami Mitchell, and 128 votes are returned for Ammi Mitchell; amounting if returned for Ammi R. Mitchell to 2806 votes, in which event, he is the other Candidate. If the Votes given for Ammi Mitchell are not considered as given for Ammi Ruhami Mitchell, then the Hon. James Means Esq. having 2786 votes, is the other Candidate. Which report being read it was Ordered that the same be recommitted; and to ascertain if there be any other citizens of the Counties of Cumberland and Oxford in the name of Ammi R. Mitchell, or of Ammi Mitchell, than Doctor Mitchell of North Yarmouth." Governor's Council Records. Ammi R. Mitchell would eventually be granted the votes and in the election in the Massachusetts General Court would be elected to the State Senate.
[5]The votes from Freeport and Pownal were rejected and the Federal votes in Sumner were not counted and apparently the votes from Dixfield were not returned.
[6]Both the Portland Gazette May 2, 1808 and Columbian Centinel. Massachusetts Federalist (Boston, MA) April 27, 1808 transposed the votes reported for Levi Hubbard and James Means as 101 votes, in the town of Paris, Oxford County.
