[21]This was the first election in which returns were reported by the American Mercury, and for various towns their results differ from those of the Connecticut Courant. These differences may arise from their different methods of counting votes. The Courant returns, with a few exceptions, are for the highest candidate on each ticket, while those given in the Mercury could be for the individual heading each ticket, or the average vote cast.

[49]"For the MERCURY. Mr. Babcock, There will be no vote returned for the republican nomination from Ashford this fall - at the Freeman's meeting, that nomination was handed to the presiding officer at the proper time to put to vote; afterwards the federal nomination was handed in, and a motion made by the a federalists, that all the names upon it should be put to vote, first, to the exclusion of all others. This was opposed as illegal. The words of the Statute, are 'He (the presiding officer) shall if the accommodations will admit thereof, order the freemen to be seated, and on any person's being named by any freeman to stand in nomination, the presiding officer shall call upon all them who would vote for the person so named to specify it by rising.' It appears plain by this law that a nomination of a single person at a time is intended, and that no man or class of men is entitled to a preference. The presiding officer however, decided that the whole federal nomination should be first put to vote severally, and this practice he declared should continue ever after, so long as he presided in the meeting. A republican freeman, not discouraged by the aforesaid decision, rose between each time of voting for the federal names, and agreeable to said law nominated aloud one of the republican candidates, and was seconded, and no other person nominated any one at each time but the presiding officer; who disregarding the nomination of the republican aforesaid, pursued putting to vote the whole federal list - Before he had gone through it, the greater part of the republicans had left the house, whereupon the remainder left it also, as soon as the federal process was finished. This specimen of conduct in the presiding officer may show to the world how federalism is supported in Connecticut. A REPUBLICAN. N. N. There were one hundred and twenty votes given in at one time, at the meeting for the republican representative candidate." American Mercury (Hartford, CT). October 6, 1808.
[50]The American Mercury (Hartford, CT) lists 148 Federalist votes and 151 Republican.
