[4]"Mr Lester was not in nomination as a candidate for the Legislature, although he received almost all the republican votes, of the town in which he resides. By a custom which has for some years prevailed in this county, the towns nominate the candidates for assembly in rotation, by meeting within themselves, in conformity with this custom Mr. Lester's place of residence precluded his nomination."
