[5]Joseph W. Reynolds' election was contested and he lost his seat, after which it was determined that; Weems, Blake, Kent and Beckett had been elected.
[6]"Taking all the circumstances together from this view of the case, if four illegal votes are taken from the memorialists' whole number, three hundred and seventy seven, they each had three hundred and seventy three; take eight votes from the whole number of votes, three hundred and seventy eight, given to Mr. Blake, he then had three hundred and seventy. (for there was proof that one of the disqualified voters did not vote for Mr. Blake but for Reynolds)- and take nine votes from Mr. Reynolds, and he had three hundred and sixty nine. After deducting the disqualified votes from the respective members to whom they were given, Messrs. Weems, Becket, Kent and Blake, had a majority of the qualified voters... Again if the House of Delegates, like a court or petit jury were bound to act from the evidence before them, and none other then it being proved by the declarations of three of the disqualified voters, that they voted for the republican ticket, the memorialist had three hundred and seventy four votes after deducting these three disqualified votes from their whole number, three hundred and seventy seven.- (It was proof that six disqualified votes were given to Mr. Blake), deduct these from the whole number, three hundred and seventy eight, given to him and he had three hundred and seventy two qualified votes. It was also in proof that Mr. Reynolds had seven disqualified votes, which deduct from his whole number and he had three hundred and seventy one, so that from this view, that the House were like a court or jury to act from the evidence before them, Weems, Becket, Kent and Blake had a majority of the qualified voters.
