This, As Counted, is the return after the votes for the Republican tickets in Hagerstown and Langley's were thrown out and based on this return, Upton Lawrence is elected by one vote over William Gabby." [6]The officially counted votes were John Bowles with 574 votes, David Schnebly with 545 votes, Moses Tabbs with 527 votes and William Gabby with 455 votes.
[7]"The following is a statement if the votes including the republican tickets which were thrown aside, and which shows if they had been counted the republican ticket would have carried by a majority of 136 votes over Mr. Lawrence the federal candidate.' Based on a technicality, (votes rejected for not having office designation on the tickets) in the voting laws, 136 votes for the republican ticket in Hagerstown and 19 in Langley's were thrown out, which allowed Upton Lawrence to be elected by one vote."
