[2]"In the afternoon, the Senators and Representatives met in Convention to fill the vacancies in the Senate as follows:--Suffolk,--one, occasioned by the death of the Hon. JOHN CODMAN. The candidates were, DAVID TILDEN and BENJAMIN AUSTIN, jun. The whole number of votes was 235--of which Mr. TILDEN had 161--was chosen, and has accepted." Columbian Centinel. [3]"Extract of a letter from our Correspondent at Boston, dated 26th April [sic], 1803. 'In the afternoon, the Senate and House met in Convention to fill the vacancies in the Senate ... The one in Suffolk was occasioned by the death of Mr. Codman; of course, there being no scattering votes of the federal ticket, and, as you know, the Constitution requiring, that the vacancy shall be filled from the two highest candidates voted for, the two highest on the unsuccessful democratic ticket became the candidates, viz. David Tilden, and Benjamin Austin, jun. Anybody on earth is to be preferred to the latter--therefore Tilden, who is but a so so democrat, had 161 of the 236 votes which the convention gave.'"
