[2]The Sheriff of Martin omitted to attend at the time and place appointed by law to compare the poll. Had he made his return, John B. Hunter would have a majority of votes. Though a doubt would have arisen as to the legality of the election in Martin, as a general muster was held on the day of the election, which is contrary to the laws of the State.
