[2]No candidate received a majority as is required by Vermont law. Phineas White was elected in the seventh trial.
[3]The Official Results list Phineas White with 1207 votes, Mark Richards with 1031 votes and James Elliot with 69 votes; however, the county totals add up to 1234 votes for White, 1046 votes for Richards and 71 votes for Elliot. The Official Results would actually leave Phineas White 4 votes short of a majority and would have required another election. The actual results leave White with an 18 vote majority. In spite of failing to achieve a majority of the reported votes, White was declared elected.
[4]Vermont Intelligencer, and Bellows Falls Advertiser (Bellows Falls, VT), November 12: "votes for Representative to Congress. The last Brattleborough Reporter gives the votes from 29 towns; White 1233, Richards 1042, Scattering 178. This gives the election to Mr. White, by a majority of 13. It is probable that statement is correct or nearly so, as we are told it is mostly derived from official sources. The votes will be publickly counted this day, (Monday the 12th instant) at 10 o'clock A.M. at the tavern in the East Parish, Westminster. A communication in the Reporter states that 'electors as well as candidates have a right to offer arguments upon the disputed questions. The law also provides that if the Sheriff and Clerk differ in opiinion, they shall call to their assistance the Judges of the county-court; and of course they have a right to adjourn from day to day until the board can be legally organized, and come to a legal decision upon all the questions presented to them.'"
[5]Vermont Republican and American Yeoman (Windsor, VT), November 12: "It is not yet ascertained, whether an election has or had been effected in the second District. The two papers printed there give returns from all the towns save Acton, which, it is said, did not vote at the last trial. By the statement of the Brattleborough paper, the aggregates of votes stand thus: For Richards 1042, White 1233, Scattering 178 ... Majority for White, over all, 13. The Bellowsfalls paper gives the result in the same towns: For Richards 1005, White 1180, Scattering 183 ... Majority against White 8. Besides, in a demi-official article in the 'Reporter' it is remarked that 'it is strongly reported, that questions, regarding the legality of the whole of the votes in one or more towns, and some small part of the votes in several other towns, will be contested before the board'."
[6]Vermont Intelligencer, and Bellows Falls Advertiser (Bellows Falls, VT). November 19, and Vermont Republican and American Yeoman (Windsor, VT), November 26: "Results of the Election. The Committee whose duty it was to count the votes for Member of Congress have decided that the number of legal votes was, for Mr. White 1207; Mr. Richards 1031; Scattering 173, giving Mr. White a majority of 3. We understand that the legality of some of the votes was questioned, but have not learned whether there will be any attampt to set aside the election; or whether all concerned will acquiese in the decision of the Committee."
[7]Vermont Intelligencer, and Bellows Falls Advertiser (Bellows Falls, VT), November 19: "OFFICIAL CANVASS Of the Votes for Representative to Congress ... Whole number of legal votes 2411, Number necessary to a choice 1207. Phinehas White has 1207, and is chosen. The votes of New-Fane were rejected as illegal, the town-meeting not having been warned according to law. Majority of legal votes for Mr. White, 3--Majority including illegal votes, 11."
