However, in December of 1822, he is elected to the United States Senate and he resigns his seat while the 17th Congress is still in session. Two special elections are held at the same time - one to replace him in the 17th Congress that is still in session, and one to replace him in the forthcoming 18th Congress. This is the election for the 17th Congress.
[3]"In the Eight Ward there were 55 votes given by the U.S. soldiers stationed at Fort M'Henry Of these 49 were for General Winder and 6 for John Barney.
