[3]75 votes for Jonathan Stanley, Jr. were cast for "Jonathan Stanley." Without the "Jr." included in the name, these votes were not credited to Jonathan Stanley, Jr. As such, Stanley's official vote total was 1297 instead of 1372, and he did not receive a seat in the Assembly. Though Stanley contested the results, he was not awarded a seat, as the Assembly determined that "it would be manifestly improper to suffer electors, or any other persons for them, to contradict the expression of their sentiments, manifested by the result of a legal canvass." Journal of the New York Assembly, 1808, 63-64.
[4]There was some contention regarding Joshua Forman's vote total. Though the official number of votes reported from the town of Virgil was "six-two," the clerk recorded the total as sixty two. However, the Assembly felt that "the presumption is so strong that the same ought to have been certified and returned as sixty two, that your committee cannot but believe that such was the real number of votes given in the said town, for the said Joshua Forman, and that such ought to have been the return thereof." Journal of the New York Assembly, 1808, 64.
